Terms of Service

1. Acceptance of terms

By accessing or using kwek ("the app", "the service"), you agree to be bound by these Terms of Service. If you do not agree, do not use kwek. These terms apply to all users, including free and premium subscribers.

2. The service

kwek is a study tool that lets users create, manage, and study flashcard decks. Features include manual card creation, AI-assisted deck generation, AI Tutor, quizzes, spaced repetition review, deck sharing, image upload on cards, and cross-device sync.

We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will make reasonable efforts to notify users of significant changes.

3. Accounts

• You must be at least 13 years old to create an account.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You may only maintain one account per person.

4. Free and premium plans

kwek offers a free plan and a premium plan (kwek²).

Free plan includes:

• Unlimited flashcard and quiz creation
• Import and export decks (JSON, CSV, Anki, PPT)
• Share deck links (view and import only)
• Image upload on cards
• Spaced repetition review
• Cross-device sync
• AI deck generation — 3 per day
• AI Tutor — 5 messages per day
• Access to built-in decks

kwek² includes everything in Free, plus:

• Unlimited AI deck generation
• AI Tutor — 30 messages per day
• Stats dashboard and study streaks
• Deck folders
• Deck collaboration (co-edit with others)
• Live quiz sessions with leaderboard

5. Billing and subscription

• Monthly plan: PHP 199.00 per month, billed monthly after the free trial period.
• Free trial: New kwek² subscribers receive a 30-day free trial. You will not be charged if you cancel before the trial ends.
• Subscriptions are managed and processed through kwek.cards. Payments are handled via PayMongo.
• Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
• You can cancel your subscription at any time from your account settings. Access to premium features continues until the end of the current billing period.
• Prices are in Philippine Peso (PHP) and are inclusive of applicable taxes.
• We reserve the right to change pricing with at least 30 days' notice to existing subscribers.

6. Refund policy

• Monthly subscriptions are non-refundable once the billing period has started.
• You will not be charged if you cancel during your free trial period before it ends.
• If you believe you were charged in error, contact us at kwek.cards@gmail.com within 14 days.
• All subscriptions are purchased directly through kwek.cards and are subject to this refund policy.

7. AI features

kwek offers two AI features: AI Deck Generation and AI Tutor. Both are powered by Groq and subject to daily usage limits depending on your plan.

• AI Deck Generation — your submitted topic or pasted text is sent to Groq's servers to generate flashcard content. Only the resulting cards are saved — your input is not stored by kwek.
• AI Tutor — your chat messages (up to 500 characters each) and a snapshot of your deck's card content are sent to Groq for each response. No chat history is stored by kwek after the session ends. AI Tutor is intended for study assistance only and is scoped to the deck you are studying.
• AI-generated and AI Tutor responses may be inaccurate, incomplete, or misleading. You are responsible for verifying any information before relying on it for academic purposes.
• You must not use any AI feature to produce harmful, illegal, or offensive content, or to attempt to circumvent, manipulate, or jailbreak the AI system.
• Inputs are subject to automated content filtering. Attempts to misuse AI features — including prompt injection attacks — are logged and may result in suspension of AI access or account termination.
• We reserve the right to suspend or permanently revoke access to AI features for users who abuse or attempt to abuse the service.

8. Your content

You retain ownership of the flashcard content you create on kwek. By using the service, you grant kwek a limited license to store and display your content solely for the purpose of providing the service to you.

You are responsible for ensuring that content you upload or generate does not infringe on the intellectual property rights of others.

9. Acceptable use

You agree not to:

• Use kwek for any unlawful purpose
• Attempt to gain unauthorized access to any part of the service
• Abuse or circumvent AI generation or AI Tutor rate limits
• Use AI Tutor for purposes unrelated to studying the associated deck
• Resell or redistribute access to kwek² features
• Use automated tools to scrape or extract content from the service

10. Termination

We reserve the right to suspend or terminate your account if you violate these terms. You may delete your account at any time from within the app. Upon termination, your data will be permanently deleted in accordance with our Privacy Policy.

11. Disclaimer of warranties

kwek is provided "as is" without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or that AI-generated content will be accurate. Use of the service is at your own risk.

12. Limitation of liability

To the fullest extent permitted by Philippine law, kwek shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service, including reliance on AI-generated content for academic purposes.

13. Governing law

These terms are governed by the laws of the Republic of the Philippines. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of the Philippines.
